We will be in the business of helping our customers to relieve their daily stresses by providing peace of mind through great ambience, convenient place, friendly customer service, and products of consistently high quality. We welcome guests of all ages; we can guarantee each guest to enjoy high-quality coffee. Vancouver Downtown has many companies, offices and shopping centers, with a strong customer base and revenue opportunities. Meanwhile, 365 days a year we will have no holiday leave, to make sure that we have opportunity to serve guests at any time. We also have a pragmatic management team. Head is the General Manager; he has a degree in Economics from the Russian Far Eastern University, and has more than six years of experience in business operations. He is the general manager, and a cafe investor. Team1 supervisor is Supervisor1 with four years of broad experience working at coffee shops and restaurant industry. Team2 supervisor is Supervisor2; he has 2 years of experience in the restaurant industry. We provide training for up to three months, including company culture, coffee brewing, food safety, and so on. All employees of our company will be well-trained and enthusiastic moderator. The financial position of the company is essential to develop the company’s financial data, including investment, net profit and so on. After the financial position and profitability assessment, in three years of operation, we expect to have profit of about 818,700 dollars (net profit after tax), with average annual net profit of 272,900 dollars will give adequate funding for our company. Compared with other coffee brands in the industry, we expect to grow faster. In the long-term, we will consider opening new cafes in different locations throughout Canada. Coffee manufactured for retail and Food service markets has been an important part of food and beverage processing in the country for many years. Coffee is the most popular hot beverage in Canada with a total of 14 billion cups consumed annually. An estimated 64% of Canadians drink coffee each day, which is equal to 6.8 kilograms of green coffee or 12.7 pounds of roasted coffee per head, with 86% of adult coffee drinkers consuming the beverage in the morning or for breakfast. In-home continues to be the dominant place for consumption with just over half of Canadian consumers (51%) drinking coffee at home. Among adult coffee drinkers, the share of cups (80%) of traditional coffee made at home is eight times higher than the share of cups purchased from the market (11%).  57% of coffee purchased at coffee shops. The coffee is also the top beverage in the Canadian Foodservice category. Canada has a highly developed away-from-home coffee market and is second only to Italy in highest percentage of total cups of coffee consumed outside the home. Other consumer demands include information on the origin/source, and locally grown, fair-trade, organic, and green coffee products. The coffee industry has been quick to respond to this lucrative market, worth about $650 million a year in Canada. Products and Services The Cafà © Vancouver will proudly offer its customers the best tasting coffee and tea beverages with breakfast style treats in the area. Our highly trained staff with a passion and talent combined will provide the best customer service in competition. The friendly and polite staff will also provide a cozy environment for customers to make them feel home, and every staff member will be required to give million dollar smile to our customers. In future, we will be looking forward to train our employees in further customer and coffee-making services. The products we offer will taste better than anything in the competition. MARKET ANALYSIS Coffee business in recent years has been a bright spot for those who want to start-up their own business. While there are a number of other businesses out there many categories facing poor sales, negative balance sheets but coffee cafes are continuing to show strong growth. Target market The place for our Cafà © Vancouver business is located at the intersection of Robson Street and Granville Street, which is in the downtown and one of the best locations for our coffee-house for opening up our cafe. According to our research we found that there is year round tourist activity all across Vancouver plus there are lots of businesses nearby our place. Robson Street is famous for its shopping stores all over Canada. In target market, we will target people from young to senior citizens. At the intersection, there are excellent auto and pedestrian traffic by the place which will give some customers each day. There are busiest areas and Sky train stations near to our place so we can attract local people or travelers passing through Downtown. Market size and trends: According to the census 2009 The Robson Street is regarded as a 3rd BIA (business improvement area) in Vancouver. The retail and service business is really higher on Robson street because of its popularity and there are 29% eating and drinking places on the Robson street. The retail business is 69% on Robson and 24% in the rest of Great Vancouver. It is one of the biggest shopping destinations in Vancouver. As the target market for our product and service is mainly tourists, local residents, business people, and students. There are 79,140 residents and 145,000 daytime employee bases; population density is triple than Vancouver average. The growth for the market had increased from last year because of the innovation; lots of people emigrated there because of business opportunities. According to the census there are 39 commercial properties and 222 businesses on the Robson Street. By targeting all market segments, Cafà © Vancouver will not focus on one segment  of market like for ma ny other coffee shops. Cafà © Vancouver will avoid these barriers in business with a customer mix of all segments and in coming years we expect to increase our market share in coffee business. The place chosen for a cafe has competitors such as Blenz coffee, Starbucks, cafe crepe, Tim Horton’s, Waves coffee, 7 eleven and David’s tea. It will be challenging to compete with well-established business, but cafe will give most delicious products at very reasonable prices. Our prime competitors (see Appendix # 1): Blenz coffee (www.blenz.com): Blenz opened their first coffee shop in February 1992 on Robson and Bute Street. They are famous for handmade coffee. They have 61 stores in British Columbia. They also are doing business internationally like in Japan and Philippines. Their store cost range from $225,000 to $400,000. Tim Horton’s (www.timhortons.com): The Tim Horton’s chain was found in 1964 in Hamilton, Ontario. The chain’s focus on top quality, always fresh product, value, great service and community leadership have allowed it to grow into the largest quick service restaurant chain in Canada specializing in always fresh coffee, baked goods and home-style lunches. Wave’s coffee (www.wavescoffee.com): The Waves Coffee House franchise was founded in 2005 at Hastings and Richards Street in downtown Vancouver British Columbia. In 2008, Waves coffee was recognized by the Brand Coaches as the â€Å"Hottest Brand in Canada†. They have also been recognized as the â€Å"Best of Brands† by over 1,500 coffee retailers. Today there are 31 Waves across British Columbia and Alberta – with more to come. Starbucks (www.starbucks.ca): Starbucks is one of our prime competitors located near intersection of Robson and Granville. Starbucks is one of biggest coffee companies in North America with headquarters in Seattle, Washington. Starbucks has 20891 stores in 62 countries and 1324 of them are in Canada with generating revenue around $13+billion. The company operates franchises and licenses more than 8,600 stores in the U.S. and Canada. Of the more than 7,800 stores the company operates and franchises in the United States, more than 6,200 are franchises. Estimated sales and market share: With the targeting mix that we are focusing on, we expect the average of 400 to 600 persons per day during the first year. We have estimated our customer expenditure about $3.5 due to premium pricing on some of the items. We presume that the total cost of sales would be about 14%. We expect the growing of our sales to 700+ customers per day for the second year of operations. And when the business will be stable and well-known we can reach the level of 800+ customers per day. The Marketing Plan Pricing There are various aims of pricing that we will focus on Survival Profit maximization Market share goals. Pricing Depends on various factors: Internal Factors- Marketing mix strategy Costs External Factors- Nature of the market Competition Competition Based Pricing- We will also be using this strategy at some stage when we get a stable number of customers in the market and then we can look at a prices level among our direct competitors, so we can adjust our prices according to that. Marketing Penetration strategy- We can charge slightly less what our direct competitors are charging for the same product. The Penetration strategy is usually used for quickly achieving a high volume of sales and to attract customers. Under this strategy product is widely promoted and price is kept comparatively low. As we will be new in the market, we will definitely go for a penetrating, this way we can have a bond with regular customers and can attract new customers. We created a detailed list of prices which we are going to start-up the cafà © with (see Appendix # 2). Advertising and Promotions Newspaper and Magazines- This will also be a good way of advertising of our product to market. We can promote our latest product in daily or weekly newspaper to give our customers as an offer for the first day of new product. We will be giving ads in local newspaper 45 days before the opening of our Cafà ©. The newspaper charges about $6 per column inch, so an ad that is two columns wide and two inches tall would be $24 for each day. Putting up Signs in Neighborhood- This is also a unique way to attract customers. The signature of our coffee shop will be placed in different locations, so people can see the ad of new coffee shops and they might come to try something new. For 100 boards it will cost around $900. Hand out values cheque- We will attract customers by giving value cheque worth $10 to first 100 customers. They will be eligible to redeem the money at any giving point of time. When we open the store, it will create a big attraction to customers. Hand out flyer discount offer - We will distribute flyers by dropping it to mail boxes, attaching any discount offer on their first coffee, sandwich or any snack. We will make our flyers on Closest to DL (95mm x 210mm) so it will be inexpensive to make 50 flyers will cost $9.74+ tax. So 1000 flyers will cost $194.80+tax. Social Media- We will also  promote our cafà © through social media like Facebook, Twitter and YouTube. We will tweet the promotional offer on twitter, so customers can have an access to discount coupons online. Website- We will create our website and advertise all our products there, so people can know about our products. There will be some discount coupons on the website, the customer could print it and redeem at any point in the store. It will cost us for a basic website $2500 to $3000 and to manage the website and to develop it $75 to $100 per hour. So this will be less expensive than social media and own company website can give people better option to have a look at our menu and daily or weekly promotions. Development plan: Development status: Our business plan is on developing stage. We have a very good plan to start our business, having the past experience of some partners will help us managing the coffee-house. We are going to lease the place in Vancouver Downtown on the intersection of Robson and Granville. We are planning to start the construction work first, after that we will give priority to the interior work. Next, we will arrange and fit the machines and dishwashers according to our layout. Along with the customer service we are providing customers with free WI-FI hotspot, cable TV and comfortable chairs and couches. So our customers can enjoy their coffee while sitting and watching TV or surfing the Internet. Proprietary issues: This is the trademark for our cafà ©. It is going to distinguish our service from those who are doing the same business in the market place. The registration of trademark is not mandatory but we are going to register it before the opening, because it gives us obvious proof of ownership. Furthermore, we are going to test our products like coffee and other eatable items through the CISPR EMC testing laboratory under the Canadian standard association plus we will test our cafà © under UL testing laboratories for safety. After getting the approval, we will give some free samples to potential customers for promotion and feedback. Operations plan Location The coffee shop will be at Granville and Robson Street in Vancouver Downtown (see Appendix # 3). It would be an excellent place with constant shoppers during the week plus business people and people who work in Downtown during weekdays. The coffee shop will be conveniently in the heart of the most popular shopping area in Vancouver and close to the Vancouver City Centre Sky Train station, which would allow attracting more transit people. Due to the enormous market size, the growth at this area rate would be considerable. The Vancouver Cafà © will give highly comfortable seats for 24 customers with hours of operation from 6AM to 8PM. Facilities The total space available for the cafà © of 600 sq. feet will offer the space for a lounge seating area, fireplace, bookshelf, back room, handicap-accessible washroom, and kitchen (See Appendix # 4). The premises are available for lease at an asking rate of $30 per square foot, net. The total annual rent would be equal to $180,000, which equates to $15,000 per month, as the listing agent informed us that the lessor is willing to reduce the monthly payment from $18,000 to $15,000. We will be eligible for the discount in case of a lease contract for at least three years term. The lessee will be expected to give a personal guarantee together with a security deposit of $10,000. Equipment To start-up our business, a variety of equipment are required. As mentioned in the â€Å"Development† section, we will need to buy a list of equipment costing in total of $ 28,344 (see Appendix # 5). All the equipment will be brand new and prices listed include delivery and setting in place. All the items will be purchased from Stealth Coffee Systems Inc. As we already negotiated, we would be eligible for an additional discount of 5%, if the amount will be paid within 90 days after the purchase. So, the estimated amount with discount will be paid for the equipment equals to $26,927. The installation of the equipment will cost us additional $ 25,000. Lead time for the delivery of the equipment is three to four weeks. The equipment will be amortized by using the straight-line method with an estimated useful life of 15 years. Supply Chain Pacific Coffee Roasters has been chosen to be the primary supplier for the best specialty coffee. The company is conveniently located in Downtown, close to our coffee shop. Pacific Coffee Roasters is a broad line coffee distributor which will satisfy all our supply needs. The inventory will be checked twice a week to make sure that we have enough in back stock. The entire inventory will be placed by dates of receiving to follow the â€Å"first in first out† system. We are expecting to place orders and receive new inventory on a weekly basis. Human Resources To operate the coffee shop we will need to hire six cashiers to split them up in two teams (see Appendix # 6). The previous restaurant experience will be required, but exceptions can be made. All the hired employees will receive an extensive training. Later, for new employees we will use on-the-job training technique to increase their performance and decrease the time of the training. A starting wage for a cashier will be $10.25 per hour; also we will use a bonus system based on the employee’s performance. Management team Is the Manager of the Vancouver Cafà © and will be responsible for overall operation of the business. Head received a degree in Economics from the Russian Far Eastern University in 2006. In addition, he is currently pursuing a Business Management Diploma at Douglas College and he will graduate from the program in December 2014. Head has an extensive experience in strategic planning, as he had been working for a production company in Russia from 2006 to 2012 as a Planning Manager. †¦Ã¢â‚¬ ¦. is the Vancouver Cafà ©Ã¢â‚¬â„¢s Supervisor of Team 1 and will be in charge of running day-to-day operations. During peak hours, he will be helping to his staff. Supervisor1 currently studies at Douglas College on Business Management program and will graduate  in December 2014. He has 4 years’ experience in the restaurant industry, as he worked at coffee shops in Vancouver. His experience varies from a cashier to a supervisor of the coffee shop. Through the work experience he recei ved a sufficient amount of expertise to run the cafà ©Ã¢â‚¬â„¢s operations. He will be responsible for the hiring and training all the cafà © employees. At this position, Supervisor1 will report to the Cafe Manager. †¦Ã¢â‚¬ ¦. is the Vancouver Cafà ©Ã¢â‚¬â„¢s Supervisor of Team 2 and will be in charge of running day-to-day operations. Supervisor2 currently studies at Douglas College on Business Administration program and will graduate in August 2014. He has 2 years’ experience in the restaurant industry. He will be supervising his staff and helping out during peak hours. He will be responsible for the purchase of supplies and management of the supply base. At this position, Supervisor2 will report to the Cafe Manager. SWOT Analysis Opening a coffee cafà © is not about knowing the difference between mocha, latte, and cappuccino but much more than this little part. Implementation schedule An implementation schedule ensures the accomplishment of each stage of the business plan. The development plan was divided into four phases: the initial phase, commencement phase, semi completion, and final phase. The team was successful in creating a business plan after a month’s collective effort. The commencement phase will begin after the initial stage. During this phase the business will be registered and thus the company becomes eligible to take financial help from a financial organization. Semi completion stage will begin after two weeks. During this phase, the process of staff recruitment, menu preparation, marketing and advertising strategies will be carried out under the guidance of experts. This phase takes a month and a half. The final phase will begin immediately after the semi completion phase. This phase consists of deciding the interior theme, furniture, appliances and other facilities to be provided at the cafà ©. Financial plan Funding Requested In order to start our business, the capital cost would be covered under the fixtures and equipment, installation of the fixtures and equipment and decorating which are 26,927, 25,000, and 10,000, respectively, for a total of 61,927. Basically, we are doing our financing from debt and equity investment which The Canadian Imperial Bank of Commerce (CIBC) has agreed to finance a large portion of this expenditure. Our 90 % of the Capital cost is covered by CIBC by using the government-granted Canada Small Business Financing Act (CSBFA) program. Interest rate would be prime plus 4.25 per cent, which includes a 1.25 per cent administration fee paid to the federal government. We will do monthly payment up to seven years in order to pay all the debt. CIBC has agreed to a loan for $ 178,090 which covers renovation expenses, personal guarantee from the owner for 25 % of the loan amount. The owner is planning that the balance of the funding will come via a $ 19,787 remaining balance, allowing him a 100 % of the common shares in the corporation. Financial Projection Cafà © Vancouver is expected to make a profit of $ 168,200 in its first year of operations, which is a good indication for the company. The $657,000 is estimated for the first year sales figures falls way above the breakeven point by $186,787(where as B-even is $470,213). Not only this, as indicated  in the cash flow projection, the initial CIBC loan and $19,787 equity investment give the operation more than adequate cash flow. This gives an opportunity to our business to repay the loan faster. Risk Factors In order to start a new business venture, there are many risks that must be taking into consideration. Below are the some of the risks associated with cafà © business: 1. Fire Safety: Cafà © Vancouver will limit the impact of a fire by ensuring the business has compensation, insurance protection, including adequate business premises insurance as well as business interruption insurance. 2. Inadequate Capital: Despite of a solid business plan many Cafe fails because they lack adequate funding and planning. So to decrease these risk Cafe Vancouver is planning to have several months of funding to cover the costs of salaries, food and bills. 3. Food Safety Concerns: If any customer becomes injured on the premises or where an illness is attributed to product the $ 1,000,000 compressive general liability insurance coverage will insure the business has adequate liability. 4. Shortage of supply: This risk is considered as not important because there are wide variety of suppliers in downtown might be chosen in case of shortages with supply. Divestiture/Harvest Strategy In case of any quarrel, any partner wants to exit the business or if sales cannot be made then the assets of the business will be sold off individually. Firstly, company will try to sell this commercial coffee making equipment locally but if the quenched arranged cannot be made locally then the equipment will be sold over the internet. The money from selling this equipment will be used to pay off the debt obligation of the business and remaining money will be paid to the owner. However, this is not supposed to happen because the concept has significant upside latent, builds good market share. If everything goes according to the plan, it is expected to attract the attention of large national. The owner would sell the business only and only if a healthy profit is given by a buyer.

IEP Inclusion Essay

The main function of the Individuals with Disabilities Education Act (IDEA) has always been to integrate the value of learning and development among special students within the educational curriculum. Recognizing the current trends and needs of students, the law was changed to address the functions of consolidating different measures to enhance approaches that bridges further effectiveness in carrying out its goals and objectives. Reacting to its application within Georgia (GA), these new tenets diversified the value of integrating new laws and furthering opportunities that infused better means of facilitation, transmission, and redirection of necessary elements essential towards increased appreciation and learning. One essential application of the amendment of the IDEA corresponds to the acquisition and training of highly qualified teachers. Since the practice of inclusion of special students within the classroom requires the necessary skills and competence among educators, the application of standards coincide not only within the precept of IDEA but also on other educational mandates such as the No Child Left behind Policy (NCLB). By ensuring that Georgian teachers are fit to meet the needs of students via training and development of necessary skills, they can help transcend towards furthering means to induce inclusion and determine the best programs available for students regardless of their physical and cognitive capacities (Hyatt, 2007). Another crucial component shaping Georgia in adherence to the needs of facilitating inclusion and the needs of special students revolves around the procedural safeguards present within the state. Here, the board of education alongside educational institutions are the ones who ensure that careful application of protective mandates is given towards special students particularly in the realm of disciplining, mediation, and the process of intervention during specific cases. Such directions can then induce better means for reinforcing accountability and responsibility among educators and administrators in congruence to the mandates provided by IDEA in reference to protective mechanism for the needs of special students and the promotion of inclusion (Hyatt, 2007). The third aspect that needs to be considered revolves around the nature of individualized education programs. Under the specific tenets advocated by the Georgian Board of Education, it has mandated and amended new conditions prior to the implementation of an IEP program. Under these conditions, it must correspond to particular standards and approved by the supervisory committee handling specific subjects and disciplines. In here, modifications within the IDEA were introduced to carry out a wider span and target new means of consolidating a wider scope in trying to reach out towards the needs of special students particularly those with disabilities (Georgia Department of Education, 2009). With regards to early intervention programs, specific attention is made by the Georgia Department of Education wherein they try to incorporate different schemes in reaching out towards special students and making them take part in government sponsored programs. In here, specific consideration is made the derivation of rubrics and EIP guidelines so as to guide both parents and educators about the appropriate model that is effective for each participant (Georgia Department of Education, 2009). Alongside this process is the condition towards centering options to help students meet the demands of their grade level and adhere to the standards provided by IDEA. The last part circumvents with the process alignment with the No Child Left behind Policy. Under this mandate, the Georgia Department of Education has corresponded and integrated its school policies and its programs according to its mandates. Here, amendments and rules were reinforced to guide educators and administrators the appropriate perspectives in helping students with disabilities become readily available and competent (Idea Partnership. org, 2007). Similarly, these conditions also center in areas such as special education services, school improvement, and addressing proficiency standards. All these conditions then necessitate better means to justify and outline congruence with both the differing perspectives and mandates provided by IDEA and NCLB. In the end, it can be argued that the Georgia Department of Education has indeed consolidated efforts towards bridging and redefining the mandates of the IDEA. Here, they had sought to help induce inclusion within the classroom by consolidating the directives provided by the IDEA and applies them according to the norms prevalent within educational institutions. By reinforcing these policies, Georgia remains responsive and accountable to the increasing needs of special students and opens up opportunities for growth and development.

An Enemy of the People

Contemporary social universal issues are reflected in common themes that are evident in extensively appreciated texts. In An Enemy of the People, the protagonist, Dr. Stockmann, sacrifices everything for his moral beliefs to assist in eliminating the corruption: Id rather see it ruined than prospering on a lie! This emotive language reinforces that he values honesty, and would rather suffer financial hardships than dishonestly gain from a hazardous industry like the baths. The Doctors fierce dedication stands out in contrast to many of the plays secondary characters who seem to compromise their supposed beliefs: I should be slow to accuse the mayor because hes your bother. But I know you think as I do – the truth should come first The high modality language emphasises that Hovstad is manipulative and duplicitous as he accuses the mayor of lying to start with, but ultimately supports him, a result of his lack of integrity. Moreover, the play exemplifies the consequences that are sometimes presented to those who have a strong sense of integrity. Dr Stockmann strives diligently to expose the sordid condition of the baths so that people do not fall ill. Eventually, however, Peters machinations turn the public against him. The irony of this play is that the good person, Dr. Stockmann, is the one labelled as the enemy of the people. The play reveals itself as a sharp examination of the terrible price that society often demands of an individual who stays true to his or her principles. Erin Brockovich reflects the same issue of needing integrity to eradicate social ills. The protagonist, Erin Brockovich, acts in a manner motivated by morals. Fighting to sustain her life with her three children as a single parent, she is concurrently fighting for the rights of people who cannot fight for themselves. Her boss, Ed Masry, initially lacks integrity to take the case on. Brockovich, who is in rage at his moral deficiency screams at him: I don’t know shit about shit! But I sure do know the difference between right and wrong! The strong colloquial language and high modality of this statement highlights the fact that ethics do not have to rely on formal education. Furthermore, through the close up shot of Masrys stunned face the audience sees that an appeal to a persons conscience can sway a persons decisions. Consequently, Masry supports Brockovich and they ultimately win the case. This demonstrates that the virtue of integrity can lead to overcoming corruption within society. An Enemy of the People reflects Erin Brockovich in that integrity is still vital for an ethical society as both their protagonists stood up for what they believed in. Stockmann was still maintaining his stand against the solid majority and the socially corrupt institutions they support. However, Brockovich, according to the films epilogue, continued to pursue other social injustice. Hence, both texts reveal that upholding integrity is imperative. Damage to the environment can lead to grave social problems within society. In An Enemy of the People, the contamination of the environment is not only the vehicle for the plays plot but also the catalyst for the conflict that is palpable during the play. Peter Stockmann is primarily motivated by greed and power, whereas, his brother, Dr. Stockmann has passionate ethical beliefs. When the doctor tells his brother about the polluted baths and that they must be fixed Peter is deeply concerned about financial loss: We should probably have to abandon the whole thing, which has cost us so much money – and then you would have ruined your native town. The emotive language used here reinforces that in Peters unethical perspective the town and its visitors health is secondary to the fact to what the town will endure economically. The circumstances of the play highlight how money the key motivation in society and demonstrates the on-going social dilemma about balancing the needs of a community with the needs of the environment, if this balance is out the effect s on society will be detrimental. Erin Brockovich also reflects the universal theme of environmental pollution. In Erin Brockovich the reason for the environmental damage is corporate greed. The multi-billion dollar company Pacific Gas and Electric, is portrayed as socially corrupt, because they did not enact policies to keep the water contaminate free, and therefore compromised the future of Hinkley. The companys deceit about the effects of chromium in the water is revealed in dialogue: So you say this hexavalent chromium Well, its poisonous? Well, its just gotta be different than whats in our water, cause ours is okay. The guys from PGE told me; I mean they sat in my kitchen and told me. They said it was fine. This underlines the companys stance, that the suffering of the environment and society is secondary to making money. The scene in which Brockovich is collecting evidence juxtaposes the close up shot of the small dead frog with a long shot of the huge power plant nearby, to raise audience awareness of the enormity of the deleterious effect of unethical behaviour. Furthermore it encapsulates the necessity of each individual opposing such behaviour. Marx made a contribution to social science by suggesting the instrumentalist theory of law in contributing to and justifying social inequality. Durkheims work orients around the key dimensions of social issues as involving both factual and normative dimensions of society. Whereas Weber is considered as the founding father par excellence of the modern sociology of law. When Weber observed that social life in the modern era had become more and more rationalized in a purposive-rational sense, he no only conte mplated the central role of economy, stat, and bureaucracy, but along with it also discussed the role of law as the basis of modern political authority. Weber specifically outlined the characteristics of a formally rationalized legal system that is primarily guided by the application of procedure. Sociology of Law The sociology of law is often described as a sub-discipline of sociology or an interdisciplinary approach within legal studies. While some socio-legal scholars see the sociology of law as necessarily belonging to the discipline of sociology, others see it as a field of research caught up in the disciplinary tensions and competitions between the two established disciplines of law and sociology. Yet, others regard it neither as a sub-discipline of sociology nor as a branch of legal studies and, instead, present it as a field of research on its own right within a broader social science tradition. For example, Roger Cotterrell describes the sociology of law without reference to mainstream sociology as the systematic, theoretically grounded, empirical study of law as a set of social practices or as an aspect or field of social experience. Irrespective of whether the sociology of law is defined as a sub-discipline of sociology, an approach within legal studies, or a field of research in its own right, it remains intellectually dependent mainly on mainstream sociology, and to lesser extent on other social sciences such as social anthropology, political science, social policy, criminology and psychology, i.e. it draws on social theories and employs social scientific methods to study law, legal institutions and legal behaviour. More specifically, the sociology of law consists of various sociological approaches to the study of law in society, which empirically examines and theorizes the interaction between law and legal institutions, on the one hand, and other (non-legal) social institutions and social factors, on the other. Areas of socio-legal inquiry include the social development of legal institutions, forms of social control, legal regulation, the interaction between legal cultures, the social construction of legal issues, legal profession, and the relation between law and social change. The sociology of law also benefits from and occasionally draws on research conducted within other fields such as comparative law, critical legal studies, jurisprudence, legal theory, law and economics and law and literature. The Classical Thinkers The roots of the sociology of law can be traced back to the works of sociologists and jurists of the turn of the previous century. The relationship between law and society was sociologically explored in the seminal works of both Max Weber and Emile Durkheim. The works of Karl Marx was not immediately influential in the development of the sociology of law as no direct historical path led from his thought to subsequent sociological schools of thought. Marxs work was later appropriated by critical sociologists who sought to break with the consensual thinking that they felt characterized much of mainstream sociology in the years after World War II. The writings on law by these classical sociologists are foundational to the entire sociology of law today. A number of other scholars, mainly jurists, also employed social scientific theories and methods in an attempt to develop sociological theories of law. Notably among these were Leon Petrazycki, Eugen Ehrlich and Georges Gurvitch. Marxs theory is not to be understood merely as a theory of the economy, for his analysis of capitalism is meant to provide the basis for an analysis of society. The economic organization of society is its material core from which all other social developments in matters of politics, culture, and law can be explained. This is summarized in Marxs famous dictum that the infrastructure of a society determines it superstructure. Thus, the division between the economic classes of owners and non-owners appears at the societal level as a class antagonism between the relatively small but powerful bourgeoisie and the relatively large but powerless proletariat. The bourgeoisie can articulate its economic power also at the political, cultural, and legal level because of its control over all important institutions of society, such as government, the legal system, art science, and education. The economic, according to Marx, only the destruction of capitalism in favor of a communist mode of product ion, whereby the workers collectively own and control the means of production, world ensure a successful revolution of society in to a more just social order. Marx did not develop a comprehensive perspective on law and his ideas on law are scattered throughout his writings. Marxs theory of the state provides the most useful entry into his perspective on law. Congruent with his materialist perspective, Marx asserts that the economic conditions of society determine what type of state will develop, which in a capitalist society implies that the state will be controlled by the bourgeoisie as an instrument to secure economic rights and to moderate class conflict. For him the capitalist state represents and secures the power of the dominant economic class which now also becomes the politically dominant class. Interestingly, Marx argues that the democratic republic, rather than being a more egalitarian form of the capitalistic state, for it totally disregards the property distinction that have arisen under capitalism. Marxs notion on law is instrumentalist, similar to that of his notion of state. He views the legal system in function of its role as an instrument of control serving bourgeois interests. Rather than abiding by a principle of the rule of law that holds that it is just for the law to be applied equally and fairly to all, Marx maintains that capitalist law actually enhances the conditions of inequality that mark capitalist society. Marx contends that the capitalist legal system contributes to inequality because capitalist law establishes and applies individualized rights of freedom, which benefit those who own while disfavoring those who are without property. The formal equality that is granted in law by treating the various parties that are in contract with one another or with the state as equal contributes to sustain and develop the economic inequalities that exist among legal subjects. Legal doctrine justifies the practices of capitalist law on the basis of a notion of justice claime d to be universally valid but which in actuality serves the interests of only the dominant economic class. The ideology of capitalist law is ultimately accepted widely even among those members of society who are economically disadvantaged and thus additionally subject to the inequalities brought about by the legal system. For Max Weber, a so-called legal rational form as a type of domination within society, is not attributable to people but to abstract norms. He understood the body of coherent and calculable law in terms of a rational-legal authority. Such coherent and calculable law formed a precondition for modern political developments and the modern bureaucratic state and developed in parallel with the growth of capitalism. Central to the development of modern law is the formal rationalisation of law on the basis of general procedures that are applied equally and fairly to all. Weber specifically outlined the characteristics of a formally rationalized legal system that is primarily guided by the application of procedures. His analysis of law is an intrinsic part of his sociology, in terms of both its perspective of the study of society and its theoretical propositions on the conditions of modern society. Modern rationalised law is also codified and impersonal in its application to specific cases. In general, Webers standpoint can be described as an external approach to law that studies the empirical characteristics of law, as opposed to the internal perspective of the legal sciences and the moral approach of the philosophy of law. Weber developed his perspective on law as part of a more general sociology. In the systematic nature and comprehensive scope of its contribution, Webers analysis is rivaled only by that of Emile Durkheim, whose sociology of law was likewise part and parcel of a more fundamental sociological perspective and theory of society. Emile Durkheim wrote in The Division of Labour in Society, that as society becomes more complex, the body of civil law concerned primarily with restitution and compensation grows at the expense of criminal laws and penal sanctions. Over time, law has undergone a transformation from repressive law to restitutive law. Restitutive law operates in societies in which there is a high degree of individual variation and emphasis on personal rights and responsibilities. For Durkheim, law is an indicator of the mode of integration of a society, which can be mechanical, among identical parts, or organic, among differentiated parts such as in industrialized societies. Durkheim also argued that a sociology of law should be developed alongside, and in close connection with, a sociology of morals, studying the development of value systems reflected in law. At sociologys heart is a concern for morality. For Durkheim, society cannot exist without moral bonds, whether these are bonds of shared belief or of mutual commitment reflecting the interdependence of individuals or social groups. Moral ideas are neither innate in the individual nor to be deduced from abstract first principles. They are inspired by the empirical conditions of social lie in particular times and places. To understand those conditions and the forces that shape social development is rationally to appreciate moralitys demands. Morality provides the normative framework of stable social relationships. In modern society these relationships are primarily domestic, economic and occupational and political relationship of citizenship. Morality expresses the requirements of living together in particular environments; the domain of the moral begins where the domain of the social begins (Durkheim, 1961:60). For Durkheim, Moral ideas are the soul (lame) of the law(1909:150). Law ex presses what is fundamental in any societys morality. So the study of law like that of morality is central to sociology. Conclusion Among the three classic thinkers Marx did not focus on law to any degree of intellectual satisfaction, while the sociological contributions of Weber and Durkheim are not only influential but foundational to the sociology of law.

Robert Cohn's Struggle for Respect in The Sun Also Rises    Jake Barnes: "You're not an aficionado?" Spanish waiter: "Me? What are bulls? Animals. Brute animals... A cornada right through the back. For fun-you understand." (Hemingway, 67)  Ã‚  Ã‚   Why does everybody hate Robert Cohn? At the beginning of Hemingway's novel, The Sun Also Rises, Jake Barnes, the story's point-of-view character, wants us to believe that he has at least some appreciation for Cohn. He relates some of Cohn's life for us, how at Princeton he was a middle weight boxing champ, how despite his physical prowess he had feelings of "shyness and inferiority...being treated as a Jew," (Hemingway, 11) his turbulent career as a magazine editor and his failed marriage. It's easy to begin to feel sorry for this guy. The only mistake he made was falling for Lady Brett Ashley. Cohn's infatuation with this heartless wench, coupled with the jealousy and competitive nature of the novel's other bon vivant characters, lead to his disgrace.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Brett Ashley is, from the start, a careless woman. A lady by marriage only, she has affairs with many men, breaks many hearts, and drinks lots of liquor. She wants to be the center of everyone's attention. She may be physically stunning, but she lacks class and restraint. Like the rest of the novel's main party, she has a taste for living the good life in disregard of the feelings and actions of others. It seems everyone loves or has loved her, including Jake Barnes. So Robert's unfortunate attraction to Brett Ashley has already heightened tensions between the male characters.   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   For a significant portion of the novel, Cohn is defending himself from the threats and name-calling of Mike, the man to whom Brett... ...on, he posed no great threat to the group and was more a victim of racism than of unrequited love. If his interest in Lady Brett amounted to anything, it was as a target for the jaded sentiments of his "fellow" bon vivants; someone should have clued Cohn in and told him he'd be better off staying in Paris. I suppose these sordid affairs only prove Hemingway's feelings, as expressed by Bill in the novel: "You're an expatriate. You've lost touch with the soil. You get precious. Fake European standards have ruined you. You drink yourself to death. You become obsessed by sex. You spend your time talking, not working." (120) Maybe Robert Cohn, a victim of this ruination, will know better than to waste his time with these dark-hearted dilettantes who hold costly ideas of enjoyment. Once I said that Diana is the light of this world. Now I know that these words were not strong enough. What she gave this world, to us her people is indescribable, but we do not seem to understand this until it is gone. Diana was a remarkable woman who gave light, hope, and love to this world. However, at the moment where she finally gained happiness and freedom she was killed. The harsh world took Diana away and left only the memories of this light, a gift from God, our Princes Diana in our hearts.

The Jungle as Socialist Propaganda In the world of economic competition that we live in today, many thrive and many are left to dig through trashcans. It has been a constant struggle throughout the modern history of society. One widely prescribed example of this struggle is Upton Sinclair's groundbreaking novel, The Jungle. The Jungle takes the reader along on a journey with a group of recent Lithuanian immigrants to America. As well as a physical journey, this is a journey into a new world for them. They have come to America, where in the early twentieth century it was said that any man willing to work an honest day would make a living and could support his family. It is an ideal that all Americans are familiar with- one of the foundations that got American society where it is today. However, while telling this story, Upton Sinclair engages the reader in a symbolic and metaphorical war against capitalism. Sinclair's contempt for capitalist society is present throughout the novel, from cover to cover, pers onified in the eagerness of Jurgis to work, the constant struggle for survival of the workers of Packingtown, the corruption of "the man" at all levels of society, and in many other ways. To understand the ways in which political systems are important to this novel, it is necessary to define both capitalism and socialism as they are relevant to The Jungle. Capitalism, and more specifically, laissez-faire capitalism, is the economic system in America. It basically means that producers and consumers have the right to accumulate and spend their money through any legal means they choose. It is the economic system most fitting with the idea of the American Dream. The American Dream portr... ... the reader. Capitalism underwent a severe attack at the hands of Upton Sinclair in this novel. By showing the misery that capitalism brought the immigrants through working conditions, living conditions, social conditions, and the overall impossibility to thrive in this new world, Sinclair opened the door for what he believed was the solution: socialism. With the details of the meatpacking industry, the government investigated and the public cried out in disgust and anger. The novel was responsible for the passage of The Pure Food and Drug Act of 1906. With the impact that Sinclair must have known this book would have, it is interesting that he also apparently tried to make it fuction as propaganda against capitalism and pro-socialism. Reflections on Social Work Essay

Social work is a profession that requires commitment to improving the lives of others as well as the community around you. As a social worker, the NASW Code of Ethics which states the mission you have as a social a social work professional. The mission â€Å"is to enhance human well-being and help meet the basic human needs of all people, with particular attention to the needs and empowerment of people who are vulnerable, oppressed, and living in poverty.† (NASW, 2008). By following these ethics, social workers are leading by example and showing that they have respect for not only their responsibilities as a social worker but more importantly, their clients. The Code of Ethics contains four major sections that make it up as a whole. The most important part of the Code may very well be the six core values: 1. Service, 2. Social justice, 3. Dignity and worth of a person, 4.Importance of human relationships, 5. Integrity, and 6. Competence. These six values outline the essence of what it means to be a social worker. By demonstrating these values through your actions as a social worker, you are showing compassion, trustworthiness, and integrity. These are just a few of the key characteristics that are essential to this profession. Although it can be hard at times, you must keep a non-biased attitude towards your clients’ situation in order to handle a situation in the most professional manner possible. Social work unique from other helping professions in that you are not only improving the life of a client, group, or family, but working hand in hand with the community around you. It is important to embrace these values in order to successfully improve the welfare of everyone involved in your profession. From a young age I believe that I have always had a passion for helping others. Helping professions also run in my family; my mother is a preschool teacher and one of the most compassionate women I know. My father has a business degree but he has surprisingly been my biggest inspiration to pursue a career in social work. In his spare time, my father is a very active member of our church and does everything he can to help with fundraisers and goes into the city every month to feed the homeless. He is also a member of Big Brothers Big Sisters in Baltimore and even won â€Å"Big Brother of the Year.† He is selfless and puts in time for these things even  with his busy career. He has encouraged me to make the most of my college years and to pursue a degree that makes me happy, not necessarily one that paid the most. In high school, at the time, I thought that my calling was to be a veterinarian and help animals. I began my college career at a small school in Pennsylvania but soon after figured out that the school and the path to being a veterinarian was not for me. When I transferred to Shepherd, I switched my major to elementary education. After the first semester, I had a chance to job shadow and take an education course but again I did not feel this major was quite the right fit. I thought long and hard about what major I could pursue that would fulfill my passion for working with children as well as help them. That is when I realized that social work was the perfect match for me. Over the past few summers, I have worked at a YMCA summer camp as a counselor. In my position, I worked with the age group of five and six year olds. However, my job went deeper than just simply supervising kids and planning activities. An aspect of my job that I never thought would affect me were the parents. Every day when the kids would get dropped off at camp I would get a chance to speak with the parents and also get a small feel for what this child’s life was like at home. It fascinated me that by just the parents I could get a glimpse of why a child behaved the way they did. It really got me thinking about how I could positively impact the lives of these children by simply making their summer at this camp a wonderful experience. It occurred to me that some of these children do not get to spend any time with their parents because they work all day every day and this is why they are at camp. It made me sad for these kids but at the same time motivated me to be the best counselor possible. As a social worker, I hope to have a profession that involves helping children; being a school guidance counselor, a therapist, or p ossibly even being a social worker in the pediatric ward of a hospital. Social work will be a good fit for me as a helping profession because I believe I have a passion for seeing and helping people improve. Some important characteristics I possess that will help me reach my potential in this profession are good listening skills, integrity towards others, compassion, and most importantly willingness to help others. A key aspect that sets social work apart from other helping professions is putting other people before yourself. This is not say that you should completely disregard your own feelings and more importantly gut feelings  about a situation, but you must be willing to put your biases aside in order to fully assist your clients. I have always been good at listening to others when they are having problems and just need a shoulder to lean on. I think that listening is extremely important, maybe even more important than giving advice. Sometimes you do not need to give your opinion or advice, but by simply listening, you are helping someone take that weight of what they were feeling off of their shoulders. Some expectations that I have of the social work profession that it will not a lways be easy and that there is potential for emotional burnout and stress. Some reservations that I have about being a social worker is that I may become too emotionally involved with a client’s situation. I know it is important to stay as impartial as possible and stay focused on helping your client in the best way you know how. It is also important to have a good relationship with your clients but at the same time you need to remain professional and unbiased. Since I want to have a job that involves working with children, it may be difficult at times to not get emotionally connected. It is harder with children because they are helpless in their living and family situations. For example, if a child is being abused at home it might be hard to not get upset and want to reach out and help that child. You are helping the child but you must do it in a way that is looking out for the child’s best interest and without getting too emotionally and personally involved. A practice setting that I would be attracted to working in would be a school or a ho spital setting. Working in a school setting, I could work face to face and individually with children as well as even groups and classrooms of children. Being a guidance counselor or just a school social worker in general, I could educate children as well as help them with their individual problems. In a hospital setting I would want to work in a pediatric setting. Working in this setting would allow me to help children who are recovering or going through traumatic sicknesses. Being able to help children who are probably scared in the hospital, I would be able to help them alongside with their families to make the experience of being in a hospital as painless as possible. A setting that does not appeal to me would be working with the geriatric population. I have visited nursing homes a handful of times to see relatives that were sick or no longer able to take care of themselves and I do not like the atmosphere. The thought of growing old and death are things that I  am not very comfortable with. However I think it is important to keep my options open and maybe later on I will develop more interest in this area after taking more social work courses. An aspect of social work that appeals to me is that no matter what work setting you are in, you are able to work alongside other professions as well to reach a common goal. Although this was only an introduction course and a small glimpse into the social work profession, I can see that that there are endless possibilities with a social work degree. It opened my eyes to so many career options that I never even knew about before and even sparked new interests. I hope that one day I have a fulfilling and rewarding career as a social worker and make a difference in the world, even if it is small.
